Welcome to the Pierce and Company website terms and conditions for use.  By using this Site, you expressly accept and agree to abide by all the terms and conditions contained in this Legal Statement.  Do not use this Site if you do not accept and agree to these terms and conditions. 

Modifications of These Terms of Use

Pierce and Company reserves the right to change, modify, add or remove portions of these Terms of Use, under which our Site is offered.  You are responsible for regularly reviewing these terms and conditions.  Your continued use of our Site after changes are posted constitutes your acceptance of this Agreement as modified by the posted changes.

Product Information

All prices displayed on the Site are quoted in U.S. dollars.  We reserve the right, without prior notice, to discontinue products, or change specifications and prices on products posted on the Site.  We reserve the right to limit the order quantity on any items without prior notice.

Product Descriptions

Pierce and Company attempts to be as accurate as possible in product representations and Site content.  Electronic images from computer monitors may not have the color accuracy or resolution necessary to depict our products with absolute accuracy.  Pierce and Company does not warrant that product descriptions, images and Site content are free of errors.  

Disclaimers

Any services, products, and materials on the Site are provided “as is” and without warranties of any kind, either express or implied.  We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or other harmful components.  Neither we nor any of our respective licensors or suppliers warrant or make any representations regarding the use or the results of the use of the service, products or materials in the Site in terms of their correctness, accuracy, reliability, or otherwise or that your use of the Site or content will not infringe the rights of any third parties.  You assume the entire cost of all necessary servicing, repair, or correction to your system.   

Delivery

We take pride in providing you with fast, dependable and safe delivery service.  Our sincere goal is to provide an enjoyable shopping experience that encourages you to shop with us for years to come. 

Handling

Shipping times on different products and manufacturers vary.  Most orders ship within 7 to 14 working days.  Orders that are on back order will vary depending upon the date they are available to ship.  Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement.  We cannot guarantee when an order will arrive.  Consider any shipping or transit time offered to you by Pierce and Company only as an estimate.

Isolated Service Areas

We cannot guarantee delivery within our usual timescales to a small number of remote rural service areas.  Please contact us to check if your address is in a remote rural area.

Small Package Deliveries

Small packages are shipped via USPS,  FedEx or UPS Standard Ground Service however larger items will ship Common Carrier Freight by the most appropriate carrier determined by Pierce and Company. Next day, 2nd day delivery can be provided upon request at additional fees.  Pierce and Company ships orders to the 48 continental states only.  For International orders Pierce and Company will ship through Freight Forwarder. 

For smaller UPS or FedEx deliveries once an order is placed we will send to you an order acknowledgement email.  We will provide an estimated delivery date.  All products are checked prior to shipping.  We deliver most items from Monday to Friday.

Small Package Carrier Damages

For items damaged in transit, please contact our customer service team immediately (within two business days) instead of refusing the package.  Call Pierce and Company at 615 385-5055.  Please be aware that replacements can be hindered or denied if the customer fails to notify Pierce and Company of defective or damaged merchandise within two business days of receipt.  Keep in mind if damages are reported immediately to Pierce and Company of UPS or Fed-Ex deliveries, we Pierce and company can file a claim on behalf of the customer and work to quickly resolve it.

Large Package Deliveries – via Freight Carrier

Once an order is placed we will send to you an order acknowledgement email.  We will provide an estimated delivery date.  All products are checked prior to dispatch.  As your product is shipped, you will be contacted by our freight carrier to book a suitable delivery time and date.  If our carrier is unable to contact the customer, the customer will then be responsible for any storage fees, freight charges back to the manufacturer in addition to the original shipment expense.  We deliver most items from Monday to Friday. 

Immediate inspection is especially important when receiving large items from Less than Truck Load (LTL), and common freight carriers.  The customer is required to inspect the goods upon receipt.  It is important to notate any damage on the bill of lading or receipt when you sign for the delivery, even if the package appears slightly damaged.  DO NOT refuse your order.  All damages should be reported to Pierce and Company within 24 hours of delivery.  Pierce and Company will identify the cause of the problem and determine the course of corrective action.

Please DO NOT refuse your order even if it appears slightly damaged.  If you refuse goods, you may be subject to re-delivery charges and storage fees.  Customers who sign for delivery and do not notate “damage” assume responsibility if merchandise is damaged.

Returns

All items are non-returnable and non-cancellable once the order has been placed.  We do not take back any returns due to customer remorse.  Only damaged items are returnable to Pierce and Company.

Damaged returned items must be UNUSED and in the ORIGINAL PACKAGING.  All damages should be reported to Pierce and Company within 24 hours of delivery.  Pierce and Company will identify the cause of the problem and determine the course of corrective action.   Items that are returned to us remain the customer’s responsibility until they are received by us in good order.  We will then contact you to arrange for a replacement to be sent to you on receipt of the damaged item.
